A Tricky situation with Income Tax

Hi All,
My wife recently got a new job in a sandwich shop. She has been there for about 4 or 5 weeks. As it stands she is not getting any wage slips with her money at the end of the week. The amount she is taking home is consistant to what she would/should take home after paying tax and NI from her Gross earnings. However I want to make sure that everything is legal and that she is working above board and paying all the neccasary tax and NI contributions Is there anyway I can check that she is payiong this with out arising suspision with the Inland Revenue? |

Thanks for the responses so far. I have talke to my wife tonight and deceided that she will quit and give a weeks notice on monday as I dont want her involved in anything dodgy. She has been the victim of bullying in work and it would seem her and her boss dont get on. She was going to stick it out until April before we went on holiday to Thailand for 3 weeks. However my worry is that her employer was not declaring her income to the Inland revenue. If ths is the case is there anything they can do to harm her She is about to apply for British citizenship and Im concerend that if they are doing anything illegal this might reflect on her and affect her chances of getting a Brittish passport. If the company was not declaring her salary without her kmowing about this is there anything we need to fear? |

Your wife should simply exercise her rights under the Employment Rights Act 1996 and write requiring her employer to supply an itemised statement of pay. If this is not forthcoming then she can ask the Employment Tribunal to order the employer to provide it (free of charge).
Your wife is doing nothing wrong. Moreover, the employer cannot terminate your wife's employment for enforcing her statutory rights. Tobias - โทเบียส |

Its highly likely that if the employer is not complying with regulations then what else is being ommitted. You might want to do the next poor soul a favour and make a few phone calls. Environmental health issues/hse etc

If she did leave make sure she gets her p45 which is proof of tax deducted (a copy is also sent to the tax office) - if they won't give her one threaten to go to your local tax office, if they still refuse then carry out your threat.
As toby says she is not doing anything wrong whatsoever but if her employer is not paying the tax deducted to the Inland Revenue they will be in trouble BIG TIME. Peter |

It's great news that she is not herself breaking the law She does not have a contract and was never offered one. Would this count against her if it ever came to light that she was not paying tax? |

I don't think we can assume that ... well certainly not yet! When the employment ceases there is an entitlement to a form P45. Lack of willingness to issue a form P45 would certainly start the alarm bells ringing, and should be reported to HMRC. Or here we could just be talking about an employer who has not got their act together on the matter of payslips, but is actually doing everything else correctly. John |

Indeed John. In practice I still come across clients who receive no formal wage slip,yet work for otherwise perfectly reputable and established businesses. Even more have no contract of employment Steve aka Rolyshark |

john ..........no assumptions but officialdom do carry random checks on employers/traders/businesses to see if they are complying with varius issues. If you suspect wrongdoing then we make the phone calls, do we need proof if we suspect ??.
This outfit must be keeping books and making submissions to the revenue(or whatever they call themselves these days) How long does it take to write out a pay slip ???? they don,t have to be elaborate. How do we do tax assessments/claim benefits without paperwork. A lack of documentation can make life very unpleasent and difficult if we fall out with revenue etc. |
