I've seen a lot about tighter visa conditions recently and occupations that people can or cannot have. My thoughts drifted onto the subject of Tailors, or more specifically, Indian Tailors, because they are the only ones I've ever seen in Thailand.

It seems to me that they are at risk under two of the restricted occupations, shop assistant and dressmaker, and yet they seem to have a stranglehold on a very lucrative business. How do they get away with it? Has anyone seen a Thai Tailors, or any other nationality for that matter.

I always assumed that they were Thai nationals???

Given the rules to become a Thai national I think it's unlikely.

Just as there are many ethnic Chinese living in Thailand who are Thai nationals by virtue of their families being resident in the Kingdom for generations, there are ethnic Indians who are the same.

Thailand’s Nationality Act B.E. 2508 as amended by Acts B.E. 2535 No. 2 and 3 (1992)

Chapter 1. Acquisition of Thai Nationality
Section 7. The following persons acquire Thai nationality by birth:

(1)A person born of a father or a mother of Thai nationality, whether within or outside the Thai Kingdom;

(2)A person born within the Thai Kingdom except the person under Section 7 bis paragraph one.

Section 7. bis. A person born within the Thai Kingdom of alien parents does not acquire Thai nationality if at the time of his birth, his lawful father or his father who did not marry his mother, or his mother was:

(1)the person having been given leniency for temporary residence in Kingdom as a special case;

(2)the person having been permitted to stay temporarily in the Kingdom;

(3)the person having entered and resided in the Thai Kingdom without permission under the law on immigration.
Which means, if I'm reading it right, that even if neither parent is a Thai national, as long as both parents are legal, permanent residents in Thailand then a child acquires Thai nationality automatically if born in the Kingdom.

I don't know about Indians, but permanent residency for English people is nearly impossible. I don't think any standard visa doesn't have to be renewed and none of them count as permanent, unless I'm mistaken the best you get is 12 months.

This is just idle curiosity by the way.

Is that a 'realistic' possibility in Thailand?

Also note that the law doesn't mention 'permanent' residency, it only refers to 'temporary' residency - two very different things!

If your family have been resident in Thailand for 2,3 or more generations, maybe? Which is the assumption I am working on regarding the ethnic Indian population in Thailand.

True, however the law says temporary residents are excluded, so logic says that permanent residents aren't. But, T.I.T. Shrug

Who said there was any logic to law Big Grin

As always in law, it is down to legal 'definitions' of terms and consequently the opposite of 'temporary resident' may not necessarily be 'permanent resident'! Eeker

In Thailand whilst one might consider himself 'permanently resident', (as in the case I presume of many ex-pats) in law his status may well still be considered that of 'temporary' resident.

Just toying with the exposition of law, not necessarily saying this is correct with respect to the actual position in Thai law.

The Thai-Indians have been in LOS for many years (we're talking hundreds). I don't know what particular piece of leglislation allowed them Thai nationality but it was well before 2508.

Many fabric shops are also run by Thai-Indians so perhaps that's how they got into the business.

They also seem to like selling Roti and nuts (no idea why)

Tailor i use in naklua,thai father and son(they make navy uniforms etc),couple doors away is another thai family tailor.

tailors in udon are thai or thai chinese and good.

main tourist hubs are full of indian tailoring shops often with thais cutting and stiching this happens well away and
often work for manys shops.

certain top end uk based tailors from saville row measure you in london transmit detail to bkk sweat shop who produce the suit etc, then send back to london airfreight for final
adjustment and finnshing before close of sale.

£80.00 in bkk selling in london for £1000.00 ++++
