Would be grateful if someone could clear this up for me:
Section 10b on the Set M application form states if you are applying as a spouse you must provide the following
But then says If you are applying as a spouse but your existing leave to enter was granted as an unmarried or same sex partner etc etc

Yes, provide them all :-)
I sent them. Better to send too much than not enough. They do send them back when you recive your wife's ILR.
I know you had to show them in order to get her FLR visa But you know what they are like.
Anything they can pick up on they will. Jobsworth and all that. good Luck.
It is badly worded you need to include marriage and divorce papers also you need translations of any marriage/divorce papers and 1 photocopy of each...

I phoned the UKBA about this matter and the woman I was talking to said she couldn't understand why the form asks for it to be included as they had already seen it when the spouse visa was granted.
To be on the safe side I included our Marriage Certificate (with translations) and my Decree Absolute with our ILR application.
