Default ILR ok to apply now?

    Hi All

Following my wifes LITUK test pass I've started filling in the online application. Just to clarify. I am correct in thinking we can apply straight away and we don't have to wait until her FLRM visa expires in January? She is here under the pre-2012 2year route and currently on her third FLRM extension

    Cheers

I don't see why not. If the end goal is to get Citizenship, then I would be applying for ILR asap, I think you now need to be living in the UK for 12 months after receiving ILR before you can apply for citizenship.

You can apply for citizenship straight after receiving ILR if you're married to a British citizen.

    From the link:
    Eligibility and fees

You’ll usually be able to apply for citizenship if you’re over 18 and have had one of the following for 12 months:

    • indefinite leave to remain in the UK
    • ‘settled status’ (also known as ‘indefinite leave to remain under the EU Settlement Scheme’)
    • indefinite leave to enter the UK (permission to move to the UK permanently from abroad)

You will not need to wait 12 months to apply if you’re married to a British citizen.
    You must also:
