    Default Confusion over dates on settlement visa

    My Thai wife entered the UK on her settlement visa - 13th June 2019

    She obtained her residence permit on - 30th May 2019 - valid until - 28th Feb 2022.

    We should apply for FLR between 2nd - 27th Feb 2022? because to my calculations that is 32 months since she entered the UK ?

    * obvious mistake - she didnt receive her BRP on the 30th May (thats before she arrived in the UK) - but that is the date issued

    Your wife needs 30 months from the date of entry before applying for FLR

    The soonest your wife can apply will be Monday 13/12/2021, which will be 30 months and 1 day (you cannot apply on a weekend), but you MUST apply before 28/02/2022.

    In the past, I would agree with you Gary. You would apply as soon as you have 30 months residency under your belt. However in the link I provided apparently you can apply 28 days before the 30 month anniversary. Which would mean, the soonest they could apply, would be 15/11/2021

    The only problem with that is you can fall foul at the next visa because you do not get the full 60 months in, you could end up 20 or so days short, an expensive mistake as you would need another FLR.
    The 28 days works when applying for the next visa, ILR at 60 months, around 16/05/24.

    The very reason why I wouldn’t even go there. It's surprising how many fall foul of the 60 month rule in their eagerness to apply early. I simply don't get it.

    We're going to leave it as late as possible so I have enough time to meet the financial requirement through savings.... thanks for the replies guys.
